Tenant Protection

If You Received a Letter From Us

If you received a letter from HRI, we have conducted an analysis of your building and suspect that tenants like yourself may be getting illegally overcharged in rent — an assessment we have made by analyzing your building’s rental income. Based on our experience, an increase larger than 20% in its net operating income in the past 10 years is suspicious in a rent-stabilized building.

If your landlord has illegally raised the rent and/or illegally removed your apartment from rent stabilization prior to your tenancy, you may be getting overcharged and at considerable risk of future rent spikes and displacement.

Know Your Rights

Rent Stabilization is the largest affordable housing program in New York City. It sets limits on how much a landlord may charge a tenant each year in rent. Rent stabilized tenants are also entitled to automatic renewal leases.

By law, tenants who have been overcharged are entitled to rent refunds and rent reductions. If you are interested in determining whether you may have an overcharge claim, please follow the instructions below.

It is critically important that you obtain the rental history of your apartment from a government agency called Homes and Community Renewal (HCR). This will tell you how much every tenant paid in your apartment from 1984 to the present.

Take Action

There are two ways in which you can request the rental history for your apartment:

  1. Visit www.amirentstabilized.com to make an online request of your rental history.
  2. Call NYS Homes and Community Renewal at 718-739-6400, press 1, press 7, and ask for your rental history dating back to 1984. Upon receiving your rental history click here to submit your information.

Important: This form is *only* for tenants that received a letter from our organization. If you did not receive a letter from us, please click here for a list of organizations who may be able to help: https://www.metcouncilonhousing.org/help-answers/finding-a-lawyer/
